These are the full Terms of Use referred to in the Legal Information section of the WAP Site.

GENERAL
The information, artwork, text, video, audio, pictures, software and other intellectual property (collectively, "Materials") contained on the WAP Site are protected by copyright and international laws. You may only access and use the Materials for personal use. You may not otherwise reproduce, distribute, publicly perform, publicly display, modify or create derivative works of the Materials (or authorise others to) for commercial gain, unless authorised by the appropriate copyright owner(s).

Framing of the WAP Site is permitted only with Universal's express agreement, and any stipulation on how the framing will be displayed or made available on any third party site shall be at Universal's sole discretion. Universal reserves the right to withhold consent for any reason and any failure to monitor or control each instance of framing shall not be considered a waiver of any of Universal's rights. Any framing by a third party shall not imply the endorsement or sponsorship of Universal.

You expressly agree that use of the WAP Site and related services is at your sole risk. The WAP Site, Materials and related services are provided on an "as is" and "as available" basis. Universal makes no representations or warranties with regard to the WAP Site or any Materials therein, whether express or implied, arising by law or otherwise, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, course of dealing or usage of trade.

By using the WAP Site, Materials or related services, you agree that Universal will not be liable for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with the viewing, use or performance of the WAP Site, Materials or related services whether due to inaccuracy, error, omission or any other cause.

Universal reserves the right to change any content on the WAP Site, including but limited to revising and/or deleting or adding features or information without prior notice to users, if, however, you have any queries or comments about the WAP Site and/or its content please let us know by sending us an email on info@umusic.com.

By using the WAP Site you agree to the Terms of Use. Universal reserves the right to prevent access to any user who is found to be in breach of these Terms of Use.
If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced. Universal's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

Changes may be made to these Terms of Use from time to time. These terms of use are governed in all aspects by the Laws of England and Wales. Legal proceedings related to the matters set out in the terms of use shall be brought and adjudicated solely in the courts of England and Wales

LINKS
The WAP Site may contain links to other WAP Sites. Universal is not responsible for or liable for the content or Terms of Use and practises of other WAP Sites. All external WAP Sites are accessed at the User’s own risk.

PURCHASING CONTENT, PRODUCTS OR SERVICES ON THE WAP SITE
If you wish to purchase any content, products or services offered on the WAP Site you will be asked to supply certain information. You may be asked to provide your name and email address and depending on the method of payment you will be asked to provide details of either your credit card or your mobile phone.

Access to certain content or products may be age restricted. Where any such restriction applies you will be asked to confirm that you are old enough to purchase the items or purchase and view the content as appropriate.

MESSAGE BOARDS/CHAT
We may monitor any message board and/or webchat area which exists on the WAP Site though we are not under any obligation to do so.

We advise you to use care and discretion when disclosing personal information on any message board or on any chat area as other users may collect and use this information and this may result in users receiving unsolicited messages from other people. Please refer to the Safe Use Guide on the Website for some guidance.

Users must not upload, post, publish or transmit any unlawful, fraudulent, libellous, defamatory, obscene, threatening abuse or otherwise objectionable information of any kind, in any area of the WAP Site including on message boards and in chat areas. Universal considers as constituting objectionable information any information which constitutes or encourages the breach of any intellectual property right including copyright whether such right is owned by Universal or any third party.

Universal reserves the right to remove or edit (without notice) any item of information which it considers to be in breach of these Terms of Use and to disclose any information as necessary or appropriate to satisfy any law, regulation or other governmental request. Universal also reserves the right to bar any user from the message board and webchat areas of the WAP Site if he or she uploads, posts, publishes or transmits objectionable information in these areas.

Any user of the WAP Site should contact us immediately by email if he or she feels that any message posted on any message board or the content of any webchat is objectionable in any way. We will then endeavour to remove the objectionable messages if we consider it to be necessary.

USE BY CHILDREN

If you are under the age of 16 you should obtain the consent of your parents or legal guardians for submitting any personal information to the WAP Site.

Children under the age of 13 should not submit any personal information without the written consent of their parents or legal guardian. If you are a child under 13 and want to submit personal information to us please ask your parent or legal guardian to send us an email at info@umusic.com specifying that they consent to us collecting your personal information through the WAP Site. SECURITY AND  PRIVACY POLICY

This is the Security and Privacy Policy referred to in the Legal Information Section of the WAP Site.

YOUR PEACE OF MIND
Universal Music Operations Limited ("Universal") operates the WAP Site and respects the security and privacy concerns of users of this and all its WAP Sites. We are notified under the Data Protection Act 1998 and comply with the Act in all our dealings with your personal data.

By using the WAP Site you agree to the terms of this privacy policy. As a general rule, no personal information (i.e. name, address, telephone number, e-mail address) is automatically collected from users of the WAP Site. However, there may be circumstances in which users voluntarily supply such information and in this event, any such information will be kept secure and confidential and will be used only for those purposes made known to users at the time the information is collected, or for the purposes specified in this Privacy Policy. We follow strict security procedures for the storage and disclosure or information you have given us in order to prevent unauthorised access.

OUR USE OF INFORMATION
The information collected is used to provide users with information on the relevant Universal Artist to customise the user's online experience and to improve the content of the WAP Site. Other uses of this information include the internal review of pages visited, tracking the progress and number of entries in promotions and contests, tracking the number of users of the WAP Site and where appropriate, product purchased through the site. Where users have signed up and opted in to receive information from us the information may also be used to notify users of future Universal product releases and information on the artist concerned together with news on other Universal artists, related products and services which may be of interest to users. If at any time you wish to stop receiving information just send as SMS message set out at the bottom of the relevant message. RESEARCH
We are always looking to improve our user experience on the WAP Site and to find out more about our users’ tastes in music. We conduct research by sending out questionnaires from time to time by email. If you receive one you do not need to complete it if you do not want to. If at any time you wish to stop receiving research questionnaires you can reply to the email address at the bottom of the email you receive. Alternatively email us at info@umusic.com and tell us you do not want to receive any more questionnaires.

PASSING INFORMATION TO THIRD PARTIES
We do not pass your details to third parties for the purposes of allowing them to market their products or service to you. Furthermore we do not market third party products or services, save for those expressly connected with the relevant artist, such as ringtones. We may, however, include advertising for third party products or services on the WAP Site or in newsletter or other mailings to you.

Universal may make changes to this privacy policy from time to time but will not change the way we use your information provided previously without your express consent.

GUIDE TO SAFE CHAT AND MESSAGEBOARD USE

Just like the Internet WAP Services are a great place to have fun. Unfortunately some people may try to use this for their own more dangerous purposes. Remember, people in chat areas and on message boards may not be who they say they are. You can’t hear them or see them so you don’t really know if they are telling the truth.

Unfortunately, you cannot automatically trust anyone you meet online or on WAP. Have a look below for advice on how best to protect yourself and make sure your experience is fun and exciting as it should be!

This guide is really aimed at younger users of the Website but the advice may be just as applicable to adult users.

IF YOU ARE UNDER 16 ALWAYS TELL A TRUSTED ADULT

If you are under 13 we always ask that you get the permission of your parents or legal guardian before joining. If you are under 16 you should always let your parents or legal guardian know that you are using a message board or chat area. If you are over 13 but under 16 you can register in your own right but as with adults using the WAP Site you should still be careful.

DO NOT GIVE OUT PERSONAL INFORMATION

You should never give out the following information about yourself:-

Full name
Address
Telephone number
Mobile number
E-mail address
School name
Log-in password


Also think about your friends and family. You should make sure you don’t give out any of this information about them.

You should use a nickname – not your real nickname or pet’s name. Take the chance to come up with a new and exciting name to use on the message board and in the chat area.

NEVER ARRANGE TO MEET A WAP PAL
You should never arrange to meet a WAP pal. However long you have been chatting or however well you think you know them it is risky. The more insistent somebody is about meeting you the more careful you should be.
If you really are determined to meet, you must tell your parents or any other trusted adult and ask them to come along with you. YOU MUST NEVER GO ALONE.

LET SOMEONE KNOW IF YOU ARE UNCOMFORTABLE

Remember, you are in control. If somebody is starting to bother you and is sending you nasty messages, you should never respond. Show the message to your parents, legal guardian, teacher or any other adult you trust. You can also log off if you feel uncomfortable.

There is absolutely no reason for anybody to put up with other people being nasty at school, home or anywhere and the Internet is no different. We never want these kind of people using our WAP Sites so please e-mail us at info@umusic.com and tell us about the nasty messages and who they came from.
